We understand you care so much about the way your personally identifiable information (hereafter referred to as "Personal Information") is handled, used, and shared, and we take your privacy seriously. This Privacy Policy (hereafter referred to as “Policy”) sets out our commitment to you as our user in terms of your privacy and describes the way we collect, use, and disclose your personal information when you visit and use the Ebiblo platform, which includes its mobile app and website (www.ebiblo.com). What information is covered by this Policy?

This Policy explains how we collect, maintain, use, store, disclose, transfer, and handle your Personal Information. Additionally, it provides your options for how your Personal Information is used, as well as your rights and how you exercise them.

This Policy applies exclusively to our method on Ebiblo to process your Personal Information in our capacity as a data controller, meaning we treat your Personal Information for our own purposes. This document does not apply to Ebiblo's processing of your Personal Information on behalf of a Creator or a service provider user. Creators or service provider users will have their own privacy policies, procedures, and data controls to handle their use of Personal Information, which will be detailed in their own terms of service and/or privacy policies.

Changes to our Privacy Policy

We continuously enhance our features and services. As a result, this Policy may need to be updated occasionally. We will notify you of such changes by publishing a note under this policy on our app, sending you an email, or using another method. Please keep in mind that even if you have opted out of receiving emails from us or have not given us your email address, the legal notices will still apply to changes to your use of Ebiblo, and these legal notices are deemed to have been read and comprehended by you.

What data do we collect?

Personal Information: When you engage with us and our services, or when you subscribe to any of our paid or unpaid services, we gather and process Personal Information about you. This may involve the following:

your first and last name;

your email;

your phone number;

your payment information (incl. billing address, credit card details, etc.);

your location and/or mailing address;

your personal pictures;

your browser or device used to access our website and app;

your marketing preferences (incl. language, privacy options, categories of content you’re interested in creating and searching content, etc.);

any information about you that we collect online and store in connection with your account, such as your username and password;

all content you have created on Ebiblo regardless of being public or private to other users;

all content you have subscribed to;

whatever information you provide to us, directly or indirectly, through your interaction with us and using our services;

any other personal information we request from you or you provided to us or a third party provide to us about you.

Sensitive information is a set of personal information that is protected to a higher degree. Sensitive information includes data on your racial or ethnic origin, political views, religion, trade union or other professional groups or memberships, philosophical ideas, sexual orientation or practices, criminal history, health information, or biometric data.

We do not solicit sensitive information about you proactively. If we ever need to acquire sensitive information about you, we will ask your permission beforehand and will only use it as necessary or as authorised by law.

How do we collect your Personal Information?

When you sign up for an account with us, use our website's form for "Contact us," or ask for our help through email, phone, and other support channels on the app and website, we gather Personal Information that is explicitly submitted by you.

We collect Personal Information about you when you use our platform in an indirect way, e.g. when you visit our website, send us an email, phone us, or make an online query.

We collect Personal Information from third parties, such as information on your website activity from our data analysis and cookie providers, along with marketing vendors. Extra details on cookies are available in the section below under "Cookies."

How do we use your Personal Information?

Here are the ways we use your Personal Information:

to come into a contractual agreement with you and perform in accordance with our obligations to you e.g. when you subscribe to a service with us or our creators. This may involve verifying your identification, processing payments, interacting with you, providing customer support;

to enable us to provide you with the services you've requested, e.g. to help you use the creator services you have subscribed to, as well as to reply to any emails, comments, or concerns you've sent us;

to grant you access to and use of our website and app;

to keep track of how much time and resources you have spent using our services;

to assist us in keeping records, monitoring, invoicing, billing, improving, and protecting our services, content, and website;

to allow us to set up, manage, customise, and protect your account with us;

to personalise our services, tailor them to your needs, and maximise the value you receive from our platform.

to keep track of all user accounts in order to be in compliance with the law and prevent, investigate, and/or report fraud, misrepresentation, terrorism, security events, and other crimes.

to conduct data analytics and research

to invite you to take part in our market research and surveys;

to send you advertising and promotional materials about our products and services, our affiliates, and chosen partners under the condition that you have explicitly allowed us to do so and that you have the right to withdraw your permission for us to send you these materials at any time;

to develop our business, which includes operating and improving the features and services we provide on our platform;

to comply with relevant laws and safeguard Ebiblo's business interests and legal rights that includes but is not limited to using the information in legal claims, regulatory, and investigative procedures. This includes disclosure of user information for the purpose of legal obligations or litigation;

to share some of your Personal Information with other parties in specific circumstances, but only as noted in this Policy;

to disclose to third-party service providers in order for them to provide services to us, such as IT service providers, storage systems, web-hosting and server providers, online marketing providers, collection agencies, delivery companies, advertising or marketing providers, advisors, and payment system operators;

to disclose to our employees, contractors, and/or associated companies, our current or prospective agents or business partners, anyone to whom our company or assets or any portion thereof are transferred or may be transferred in good faith, courts, tribunals, and regulatory authorities, in the event you fail to pay for products or services we have given to you;

to disclose to any other third parties as necessary or authorised by law, such as when a warrant is issued.

Who do we share your Personal Information with?

On Ebiblo, we may share your Personal Information with the following third parties:

Our affiliates; i.e. our corporate subsidiaries and partners.

Creator users: When you subscribe to Contents, we supply creator users with the information they need, such as your name and email address, so that creator users can provide their material to you and enable them to provide you with services.

Other users: You may allow your user profile to display your name, your personal picture, public subscriptions, social media usernames, etc. To enhance user engagement on the Ebiblo app, we allow user profile information to be submitted and be visible to other users. You may choose to limit how much other users can view your Personal Information on your user profile. Do so at your own discretion. Your username will be visible on your profile page to other users, and other users will be able to contact you by mentioning you in the comments.

Service providers: We use third-party service providers that perform functions for us, and we use their services to enhance our platform functionalities for you. So, we may fully or partially share your Personal Information with these third parties. For instance, we outsource our payment services to Stripe, which enables us to process credit card transactions for our users. We also outsource a variety of services to third-party service providers, including web and server hosting, storage, and computing services, e-mail services, security of our infrastructure, some software services, web traffic and web analytics services, etc.

Future owners of Ebiblo: In accordance with local laws and in conjunction with the sale or merger of our company or assets, we may exchange and/or transfer our users' information to a potential seller or buyer. This transfer of user information may also happen if we go out of business, declare bankruptcy, or undergo any other significant change in our control.

Governmental and law enforcement authorities: We may share Personal Information with governments, regulatory bodies, courts, tax, or other competent official parties in any jurisdiction, domestic or foreign, that is required by law or required for the protection of our legitimate interests in accordance with applicable laws.

We retain and reserve the right to use and share anonymised data with the above selected third parties. We never share de-identified data in a way that might be used to identify you personally.

Where do we store your Personal Information?

Ebiblo Pty Ltd is a company registered in Australia that processes Personal Information via service partners based in Australia and other countries and as defined in this Policy. As a result, your Personal Information may be shared with other parties inside and outside Australia.

How secure is your Personal Information with us?

You can access your Ebiblo account only with a secure link supplied to you via email or you can log in through other third-party authentication services that are available on the Ebiblo platform.

To prevent unauthorised access to your account and personal information, you must restrict access to your computer or device and browser by signing out once you have completed accessing your account.

We make every effort to keep the privacy of your account and any Personal Information in our records secure, but we can't guarantee it. At any moment, unauthorised access or use, service failure, or other reasons might compromise the security of your Personal Information.

Your rights under this Policy

You have the right to object to direct marketing processing, unsubscribe from our email database, or opt-out of communications e.g. marketing communications. Please contact us at support@ebiblo.com.

You have the right to seek access to the Personal Information we have on you. Please be aware that we may be legally authorised to deny access to your Personal Information in certain circumstances.

If we are unable to offer access to your information, we will notify you as soon as reasonably practicable and provide you with the reasons for our rejection, as well as any accessible mechanisms for filing a complaint.

If we can offer access to your information in a different format that still meets your requirements, we will do so as soon as possible.

We will investigate your complaint immediately and reply to you in writing, including the results of our investigation and the measures we will take in response to your complaint.

If you are dissatisfied with our answer, you have the option of contacting the Australian Information Commissioner's Office.

How long do we keep your Personal Information?

We only retain your Personal Information for as long as it is required to do the intended tasks based on that information. If we reasonably think there is a risk of litigation arising from our engagement with you, we may keep your Personal Information for a longer time..

From time to time, cookies may be used on our website. Cookies are little text files that are stored in your browser on your computer. Cookies don't give us your email ID or any other personally-identifying information by themselves. If you choose to contribute personal information to our online website, such information may be connected to the cookie data. The Ebiblo platform, including the website and mobile app, may include external links to websites or apps other than our platform. We have no control over such websites or apps, and we cannot be held liable for the security or privacy of any Personal Information you supply when accessing them. This Policy does not apply to such websites or apps.

We reserve the right to change this Policy periodically and at our sole discretion by publishing the revised Privacy Policy on our apps and websites. We urge you to visit our website frequently to ensure that you are aware of the most recent version of our Privacy Policy.
